OTTIMA s. r. o., instruction on the processing of personal data

The company OTTIMA s.r.o., with registered office at 186 00 Prague 8, Thámova 21/34, ID No. 04279727, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File 04279727 (hereinafter referred to as the “Company”) as a personal data controller pursuant to Act No. 110/2016 Coll, on the processing of personal data, as amended (hereinafter referred to as the “PDPA”), within the meaning of the General Data Protection Regulation, i.e. Regulation (EU) 2016/679 of the European Parliament and of the Council (hereinafter referred to as the “Regulation”), and within the meaning of Act No. 127/2005 Coll., on Electronic Communications, as amended (hereinafter referred to as the “ECA”), communicates to its clients, business partners (natural persons) (hereinafter collectively referred to as the “data subject”) the following basic rules for the handling of personal data:

1) Personal data processed

The Company processes personal data provided by the data subject: name and surname, titles, residence or place of business, date of birth, contact details and, depending on the nature of the matter, business name, identification number, tax identification number, type and number of personal document and, where applicable, data required by generally binding legal regulations. Other personal data processed may also include data on the job applicant’s education, experience, knowledge and skills, the content of the CV, and likeness. The company may also collect records of mutual communication (telephone calls or mutual written communication). If the settings of the applications or web browser used by the data subject allow us to do so, the Company may also obtain and process other personal data. The Company may also process personal data obtained from public sources, i.e. sources that are publicly accessible and in particular operated by public authorities or their organisations.

2) Duration of data processing

The Company processes personal data according to the purpose for which they were obtained, in particular for the duration of the contractual relationship and for the period of limitation. In other cases, for the period specified in the consent to the processing of personal data, which is 5 years, or until the consent to the processing of personal data is withdrawn.

3) Provision of personal data by the data subject

The provision of personal data is voluntary. However, without the provision of personal data, a contractual relationship cannot be concluded or employment can be arranged. In the case of personal data that have not been provided in the context of a contractual relationship, the data subject has the right to withdraw his/her consent to the processing of personal data free of charge at the company’s e-mail address info@ottima.cz.

4) Sources of the personal data processed

The Company primarily processes personal data provided by the data subject in the context of the negotiation of the contractual relationship or during its execution, as well as from public sources. Based on the specific consent of the data subject or the permission settings of the applications or web browsers used, the company may also process personal data from these sources.

5) Purposes of the processing of personal data

The Company processes personal data for the purpose of entering into a contractual relationship, its performance, employment, training and development, HR and business consultancy, for the protection of its rights and legally protected interests and for the Company’s business and marketing activities.

6) Method of protection of personal data

Personal data is under constant legal, physical, electronic and procedural control and the Company has all up-to-date technical, hardware, software, control and security procedures to ensure the highest level of protection of personal data from unauthorized handling or damage, loss or destruction. All persons who come into contact with personal data have either a legal duty of confidentiality or a contractual obligation of confidentiality.

7) Disclosure of personal data by companies

The Company primarily processes personal data by its employees. In addition, personal data may be provided to the administrative authorities at their request in accordance with generally binding regulation. The Company may also provide personal data to certain service providers (processors), but always on the basis of a contract that obliges the processor to the same or greater level of protection of personal data as the Company provides. The processors of personal data are mainly IT service providers, accounting and tax advisors, legal firms, and possibly also marketing service providers, human resources consultants, trainers. With the consent of the data subject, personal data may also be provided to other specific entities.

8) Rights of the data subject

Where the company processes personal data only on the basis of consent, the data subject has the right to withdraw this consent at any time by contacting info@ottima.cz.

The data subject has the right to contact the company at info@ottima.cz, or in writing to the company’s registered office address, if he or she believes that the company has violated his or her rights in connection with the processing of personal data. Each submission made by the data subject will be processed and evaluated, and the result of the investigation will be reported to the data subject in the manner in which the company was contacted. Any objection relating to the processing of personal data for marketing purposes will always be upheld.

In particular, the data subject is entitled to the following rights in relation to the processing of personal data:

(a) the right to information about the processing carried out,

(b) the right of access to the personal data processed,

(c) the right to rectification or erasure of personal data,

(d) the right to restrict the processing of personal data,

(e) the right to the portability of personal data,

(f) the right to object to processing; and

(g) the right to lodge a complaint with the supervisory authority, which is the Office for Personal Data Protection (uoou.cz).

Other rights and obligations relating to personal data are set out in the Act, the Regulation and also in certain other generally binding legislation.

9) Use of contact data

The contact details provided (telephone, e-mail) may be used by the Company for the purpose of sending commercial communications relating to the Company’s services only. The data subject has the right to refuse the sending of commercial communications at any time, free of charge, via a link within the commercial communication or by sending a message to the e-mail address info@ottima.cz. Please note that not every message in the form of a mass mailing from the Company to the data subject is a commercial communication. Where there is a need to communicate the same information to a large number of data subjects in the context of a contractual relationship or in the performance of the Company’s obligations to data subjects, the Company may use bulk correspondence. Therefore, information of this nature will be sent even if you refuse to send commercial communications for the duration of the contractual relationship.

10) Information on the principles and rules for processing personal data

In addition to this information, the data subject is informed in the contractual documentation and whenever he or she provides the company with additional, not yet registered personal data.

If so-called cookies are personal data, they are used by the company to measure the traffic of the Internet portal and to generate statistics concerning the traffic and behaviour of visitors to the Internet portal and the basic functionality of the Internet portal. On the Internet portal, the data subject is given the opportunity to choose the scope of the processed data about his/her activity on the Internet portal. This option is located on the bottom bar of the Internet portal and is marked: cookie settings.

11) Exercise of state supervision over personal data

As mentioned above, the State Supervisory Authority for Personal Data is responsible for the exercise of state supervision over personal data, where it is possible to obtain information in the area of personal data processing and, in the event of disagreement with the resolution of the company’s objection to the processing of personal data, the data subject has the right to contact the Authority with his/her complaint (www.uoou.cz).
